The petitioner seeks regular bail in connection with Ahiyapur P.S. Case No. 1294 of 2018, registered for the offence punishable under Sections 341, 323, 504, 506, 307 and 379/34 of the Indian Penal Code.

The allegation is regarding the accused persons having assaulted the informant and snatched a bag from him containing a sum of Rs. 50,000/- on pistol point. As far as the petitioner is concerned, he is said to have assaulted the informant. The learned counsel for the petitioner submits that the petitioner is innocent and the injury, if any, found on the person of the informant is simple in nature. It is further submitted that similarly situated co-accused person has already been granted

Patna High Court CR. MISC. No.70570 of 2019(2) dt.04-12-2019 2/2 the privilege of bail by a coordinate Bench of this Court vide order dated 1.10.2019 passed in Criminal Miscellaneous No. 58292 of 2019. Lastly, it is submitted that the petitioner is languishing in custody since 16.7.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Ahiyapur P.S. Case No. 1294 of 2018.
