2. The petitioner seeks bail in a case registered for the offence punishable under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a), 36 and 41(i) of the Bihar Prohibition and Excise Act.
3. Earlier, prayer for anticipatory bail of the petitioner was allowed vide order dated 23.12.2022 passed in Cr. Misc. No. 67875 of 2022 with a direction to deposit a sum of Rs. 40,000/- in the account of Patna High Court Legal Service Committee, Patna.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that the petitioner has already deposited the aforesaid amount in the
Patna High Court CR. MISC. No.76525 of 2024(2) dt.20-12-2024 2/2 account of Patna High Court Legal Services Committee, Patna. He submits that the petitioner has three criminal antecedents as mentioned in para-3 of this application and he is languishing in judicial custody since 12.08.2024.
5. Learned APP for the State opposed the prayer for bail.
6. Considering the facts and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Malaypur P.S. Case No. 58 of 2021.
