Petitioner seeks bail in Bettiah Town P.S. Case No. 776 of 2013 registered for the offence punishable under Sections 333, 353, 307, 387/34 of the Indian Penal Code and Section 27 of the Arms Act.

Informant in his written complaint has stated that while he was sitting in his office two unknown criminals fired upon him which hit back the wall behind him and thereafter he received call on his mobile and the person on the mobile stated that he has got the firing made and disclosed his name as Sameer Ansari.

It has been submitted on behalf of the petitioner that

No.41945 of 2018(3) dt.29-08-2018 2/2 the petitioner is not involved in any way in this incident and his name has surfaced in this case on the basis of confessional statement of co-accused Aman Srivastava, who has already been granted bail. Similarly, situated co-accused persons namely Aman Srivastava, Raju Rose and Sameer Ansari have been granted bail by co-ordinate benches of this Court vide orders dated 13.11.2014 in Criminal Revision No. 459 of 2014, dated 30.01.2016 in Criminal Miscellaneous No. 53811 of 2015 and 18.05.2018 in Criminal Miscellaneous No. 6505 of 2018. Petitioner is in custody since 17.03.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah (West Champaran) in connection with Bettiah Town P.S. Case No. 776 of 2013.
