1. The State of Bihar.

.... .... Opposite Party ====================================================== Appearance :

For the Petitioner/s : Mr. Anupa Nand Jha For the Opposite Party/s : Mr. Anil Prasad Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-01-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Sikandra P.S. Case No. 75 of 2016, registered under Sections 341, 307/34 of the Indian Penal Code, pending in the court of A.C.J.M-II, Jamui. Learned counsel appearing on behalf of the petitioner submits that admittedly the prayer for bail of the petitioner was earlier refused on 26.04.2017 passed in Criminal Miscellaneous No. 15106 of 2016 on merit taking into consideration the nature of allegation. The petitioner is in custody since 06.02.2017. Further submission is that injury as said to be caused by the petitioner at the left elbow, which is not the vital part.

Under the above facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, the application stands rejected. However, the petitioner would be at liberty
