JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Special ( Drugs and Cosmetic) Case No. 03 of 2019, arising out of Bangoan P.S. Case No. 100 of 2019 registered for the offences punishable under Sections 13, 18 (A) 27A 36 (ac) of Drugs and Cosmetic Act 2008.

As per F.I.R there is recovery of huge quantity of cough syrup and other materials from the house of the petitioner.

Submission of the learned counsel for the petitioner is that it is a joint house where recovery has been made and further submitted that nothing available on record that same has been sent for chemical examination or not.

Having heard both sides, considering the fact that this

No.68635 of 2019(2) dt.25-10-2019 2/2 application is disposed of with a direction to the petitioner to surrender before the learned Court below within four weeks from the receipt of this order and on surrender petitioner be released on provisional bail to the satisfaction of the lower Court till submission of charge-sheet and petitioner is directed to co-operate in the investigation and after completion of investigation if material is found against the petitioner and he is found indulged in the case he has to surrender before the learned court below and pray for regular bail.
