The prayer of bail of the petitioner was earlier rejected vide order dated 08.01.2018 passed in Cr. Misc. No. 53538 of 2017 in connection with Wazirganj P.S. Case No. 38 of 2017.

The petitioner has approached this Court again for grant of bail as sufficient time has elapsed since his period of custody and the trial has not progressed.

This Court, on an earlier occasion, had called for a report from the Trial Court regarding the stage of the trial.

Patna High Court Cr.Misc. No.49928 of 2018(3) dt.12-12-2018 2/2 The report, which has since been received, discloses that the case has only recently been transferred from one Court to the other and there has not been any progress in the trial. Regard being had to the fact that the petitioner is in custody since 24.01.2017, the Trial Court is directed to conclude the trial preferably within a period of eight months from the date of receipt/production of a copy of this order, failing which, the petitioner may approach this Court again for grant of bail.

With the aforesaid observation, the application stands disposed off.
