The petitioner seeks bail in connection with Bhaptiyahi P.S. Case No. 131 of 2018, registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that similarly situated co-accused persons have been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 26709 of 2019 vide order dated 04.06.2019 and Cr. Misc. No. 36589 of 2019 vide order dated 18.06.2019. The petitioner is in custody since 30.07.2019.

No.66975 of 2019(2) dt.14-11-2019 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Bhaptiyahi P.S. Case No. 138 of 2018.
