2. The petitioner apprehends his arrest in connection with Athmalgola P.S. Case No. 41 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 109(1), 352, 351(2) and 3(5) of BNS and Section 27 of the Arms Act.
3. As per the allegation, the petitioner has abused and assaulted the informant and his family members, due to which they received injuries.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. Both the parties are agnates. There is case and
Patna High Court CR. MISC. No.71766 of 2025(2) dt.14-10-2025 2/2 counter case between the parties. He has further submitted that the allegation of assault is against other co-accused persons, not against the present petitioner. Petitioner is not involved in any other case except one case, which has been disclosed in paragraph 3, which is under Bihar Prohibition and Excise Act.
5. On the other hand, the learned APP for the State has opposed the prayer for bail.
6. Considering the above-mentioned facts that specific allegation of assault is not against this petitioner, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Civil Court Barh, Patna in connection with Athmalgola P.S. Case No. 41 of 2025, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nawneet Kumar Pandey, J) AjayMishra/- U T
