Patna High Court L.P.A No.1296 of 2019 dt.22-03-2021 2/3 against the judgment dated 02.09.2019 passed by a learned Single Judge of this Court in C.W.J.C. No. 6206 of 2012 titled as (Dr. Narendra Pratap Singh Vs. The State of Bihar and Ors.) A communication dated dated 23rd of February, 2021 is placed on record whereby present appellant/writ petitioner stands appointed as a Professor and Head, Department of psychiatric, Patna Medical College, Patna. Also Private respondent no. 8, namely Mr. Pramod Kumar Singh has since retired.
According to Sri Y.V. Giri, the learned Senior Advocate, in view of such intervening developments, no adjudication is required.
As such under instructions from the appellant, he states that liberty be granted to the petitioner/appellant for raising the surviving issue(s), at the appropriate level before the Government.
State has no objection to the same.
As such, present appeal, as prayed for, stands disposed of reserving liberty to the appellant to raise the surviving issue(s), if any, at the appropriate level in the Government. Similarly his representation shall be considered and disposed of, uninfluenced of the observations made in the
Patna High Court L.P.A No.1296 of 2019 dt.22-03-2021 3/3 impugned judgment. It shall be open for the appropriate authority to consider and decide the case of the appellant on its own merit.
