JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 254 of 2018, disclosing offences under Section 354(B) of the Indian Penal Code. As per complaint petition, there is allegation against the petitioner that he abused the complainant and caught hold her and also tore her blouse.

Submission of learned counsel for the petitioner is that there is delay in lodging the complaint petition. Moreover brother of the petitioner has filed a case against the complainant and due to which, this present case has been filed by the complainant and no such occurrence has ever taken place as mentioned in the complaint petition.

Having heard both sides, considering facts and circumstances, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IV, Arwal,, in connection with Complaint Case No. 254 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
