Petitioner, already in custody, seeks bail in connection with Saraiya P.S. Case No.12 of 2017 registered under Sections 406 and 420 of the Indian Penal Code as well as under Section 138 of Negotiable Instrument Act.

Earlier the petitioner was granted provisional bail vide order dated 03.04.2018 for three months and after release, he had to deposit a draft of Rs.1,00,000/- in the name of the informant and subsequently draft of Rs.50,000/- each in two installments in consecutive two months but the same has not been deposited as appears from the report dated 23.07.2018 submitted by the court below, so the provisional bail granted to

Patna High Court Cr.Misc. No.7753 of 2018(5) dt.31-07-2018 2/2 the petitioner vide order dated 03.04.2018 is hereby cancelled and the court below is directed to take all coercive steps for taking petitioner in judicial custody.
