The petitioner, already in custody, seeks bail in connection with Haspura P.S.Case No. 233 of 2016 registered under Sections 323, 341, 386 and 504/34 of the Indian penal Code and Section 37B of the Bihar Prohibition and Excise Act, 2016. Allegation in brief is that this petitioner was found in drunken state and one of the co-accused asked cigarette from the informant's shop but on demand of payment, they declined to give money and also abused and assaulted the informant and just then police came and apprehended them.

Submission is that only allegation against this petitioner is that he was found in a drunken condition but there is no any breathe analyzer report or medical report to show that he

Having considered the aforesaid facts and circumstances, the petitioner, namely , Ravi Kumar Gupta, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad in connection with Haspura P.S.
