JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-11-2018 Learned counsel for the petitioner is permitted to make necessary correction in paragraph - 1 of the petition. The petitioner seeks regular bail in connection with Nathnagar Lalmatiya P.S. Case No. 380 of 2016, registered for offences punishable under Sections 394, 307/34 of the Indian Penal Code.
Allegation as per F.I.R that while the informant was taking cooking oil and edible etc on his pick up van and was going towards the Sultanganj, some motorcycle borne miscreants came and snatched his mobile and also made firing, which hit on his chick. Petitioner was identified in CCTV footage.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.54063 of 2018(3) dt.02-11-2018 2/2 he has not been named in the F.I.R and he has also not been put up on T.I.P. Further submission is that he has been dragged in this case only on suspicion and except that there is nothing against him and he has been in judicial custody since 24.04.2018.
Learned counsel for the State opposed the prayer for bail on the ground that petitioner has criminal antecedent as he is accused in five other cases.
Having heard both sides, considering the facts and circumstances of the case and the criminal antecedent of the petitioner, I am not inclined to enlarge the petitioner on bail. This application is accordingly dismissed.
