1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307 and 3(5) of the BNS.
3. Learned counsel for the petitioners submits that petitioner no. 1 has antecedent of one case, petitioner no. 2 has antecedent of three cases and petitioner no. 3 has antecedent of five cases and the informant alleges that accused persons including the petitioners came and took away the paddy crops from his field but the informant did not oppose fearing he will be assaulted.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the
Patna High Court CR. MISC. No.72882 of 2025(2) dt.12-11-2025 2/2 informant. It is further submitted that land dispute is going on in between the parties and the land from which the paddy was taken belongs to the petitioners but then the instant false case came to be instituted with no overt allegation. It is next submitted that the criminal antecedents, which the petitioners carry, have also been instituted by the informant.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Paliganj P.S. Case No. 62 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
