JUSTICE SANJAY PRIYA ORAL ORDER 26-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Digha P.S. Case No. 179 of 2018 instituted for the offence under Sections 302, 402 of the Indian Penal Code, Sections 25(1-b)a and 26 of the Arms Act. It is alleged in the written report that one loaded country made pistol, one live cartridge and one Mobile Phone were recovered from possession of the petitioner. Counsel for the petitioner submits that petitioner is in custody since 4.4.2018. Counsel for the petitioner further submits that co-accused Arjun Ram has been granted bail by a coordinate Bench of this Court vide order dated 20.08.2018 passed in Cr. Misc. 49414 of 2018.
Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.51483 of 2018 (3) dt.26-09-2018 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Patna, in connection with Digha P.S. Case No. 179 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
