1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 127(1), 115(2), 117(2), 109, 125(A) and 125(B) of the BNS.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that the named accused persons including the petitioner along with 20-25 unknown accused came and Chhotu Kumar assaulted her by sword causing injury on her thigh while Jaiki Kumar assaulted her by leg. Further, Karan Kumar and Raja Kumar fired in the air.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the
Patna High Court CR. MISC. No.73383 of 2025(2) dt.17-11-2025 2/2 informant. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that specific allegation of assaulting the injured is against Chhotu Kumar and Jaiki Kumar and as far as petitioner is concerned, the allegation against him is general and omnibus in nature.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Chakand P.S. Case No. 65 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
