JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Samastipur Mahila P.S. Case No. 40 of 2019, registered for the offences punishable under Sections 498A, 341, 323, 504, 379, 34 of the Indian Penal Code. As per F.I.R. petitioner with respect to demand of rupees one lac for business purpose assaulted her and ousted her from the house.

Submission of the learned counsel for the petitioner is that after 18 years of marriage the present case has been lodged. There is no specific allegation has been attributed against the petitioner and he is still ready to keep the informant with full dignity and care as children born from their marriage

Having heard both sides, considering the above submission, this application allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. 1st Samastipur in connection with Samastipur Mahila P.S. Case No.-40 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned with further condition that informant appears before the Court below and if she is ready to reside with the petitioner and petitioner has to keep her with full dignity and care otherwise informant shall at liberty to move for cancellation of his bail bonsds.
