This is a petition for grant of regular bail for offences under Sections 20 and 22 of the N.D.P.S. Act. From a Scorpio vehicle 67kg ganja was recovered, which was kept separately, hidden in different parts of the vehicle. Petitioner was also travelling on the same vehicle. The driver confessed that he is indulged in the business of the recovered narcotics. Some other persons are also involved including the owner of the vehicle.
Submission of the petitioner is that the petitioner is female and she has got no criminal antecedent. She was simply a passenger. There is no other material in the case diary against the
Patna High Court Cr.Misc. No.16805 of 2017 (3) dt.16-05-2017 2/2 petitioner.
Considering the facts that the recovery was not made from conscious possession of the petitioner and the petitioner has no criminal antecedent and she is female, the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Bhagalpur in connection with Kahalgaon P.S.
