====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-08-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Gopalpur P.S. Case No.134 of 2016 registered under Sections 302 and 120B/34 of the Indian Penal Code besides Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner is not named in the F.I.R. In course of investigation, the name of one Pawan Yadav, has come in the light, on the basis of the information of the spy, having hand in the present occurrence. Thereafter, Pawan Yadav was apprehended and his confessional statement was recorded in which he has stated about committing

Further submission is that except that, no tangible material has been collected against the petitioner during investigation. Further submission is that the petitioner is in custody since 03.04.2017. While the petitioner is accused in seven other cases, as detailed in paragraph-3 to this application, but in all the seven cases, the petitioner is on bail. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Naugachia, in connection with Gopalpur P.S. Case No.134 of 2016. Out of the two sureties, one must be either parents or close relative of the petitioner.
