JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 This is an application for grant of anticipatory bail in connection with Paraiya P. S. Case No. 66 of 2019, disclosing offences under Sections 147, 148, 149, 307, 379 and 385 of IPC. As per F.I.R. there is allegation against petitioner no.1 of assault by Fasuli on the head of the informant, causing injury and against petitioner no.2 there is allegation of snatching Rs.4000/- from the informant. Apart from that it appears that petitioners are accused in eight other cases. Submission of the learned counsel for the petitioners is that there is land dispute between the parties, due to which, they have falsely been implicated in this case. Apart from that they have also implicated in several other cases. Heard learned A.P.P. also, who has opposed the prayer

Patna High Court CR. MISC. No.64954 of 2019(2) dt.18-10-2019 2/2 for anticipatory bail on the ground that all the injuries have been found to be the dangerous of life.

Having heard both sides, considering the above submissions, so far as, petitioner no.1 is concerned, I am not inclined to grant privilege of anticipatory bail to him. However, he may surrender and pray for regular bail before the learned court below.

So far as, petitioner no.2, is concerned, let the petitioner no.2, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Paraiya P. S. Case No. 66 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
