The petitioner, who is in custody, seeks bail in connection with Sheikhpura P.S. Case No. 249 of 2017 registered for the offence punishable under Sections 307, 429/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against petitioner is that petitioner and one co-accused were quarreling with each other and resorted to firing, in which a buffalo of the informant received gun shot injury and died.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in

It has been further submitted that witness, namely Gaungu Yadav, who is own father of the informant, has stated in para 13 of the case diary that the co-accused namely Uday Yadav fired which hit the buffalo. Petitioner is in custody since 14.07.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura P.S. Case No. 249 of 2017.
