The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 341, 323, 324, 307, 504, 506 of the Indian Penal Code. As per prosecution case, on 18.12.2021 at about 04:00 PM, the informant was going for work, in the meantime, the accused persons including the petitioner came and started assaulting with intention to kill him, as a result of which the informant sustained injuries.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to previous enmity. The alleged occurrence is said to taken place on 18.12.2021 but the
Patna High Court CR. MISC. No.72010 of 2022(2) dt.17-03-2023 2/2 FIR has been lodged in 15 days delay on 2.1.2022. As per supplementary injury report, the informant received only one injury. It is further submitted that good sense has been prevailed between the parties and in this respect, compromise petition has been filed vide Annexure-3. Moreover, the petitioner is languishing in judicial custody since 12.9.2022. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sabour P.S. Case No. 02 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur.
