JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-10-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 20.11.2017 passed in Cr.Misc.No. 49330 of 2017 and the allegation against the petitioner of committing rape on a minor girl aged about nine years. Submission of learned counsel for the petitioner is that petitioner is in custody for more than one year and there is no substantive progress in trial till date.

Heard learned APP and from perusal of the report it appears that only charge has been framed and for appearance of witnesses process have been issued.

Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner.

Patna High Court Cr.Misc. No.54173 of 2018 (3) dt.10-10-2018 2/2 However, since the petitioner is in custody for more than one year, learned trial court is directed to expedite the trial and, if possible, by conducting it on regular basis so that the trial may be concluded as early as possible.
