2. This application, for grant of anticipatory bail, arises out of Phulwarisharif Police Station Case No. 532 of 2024, disclosing offences under Sections 419, 420, 467, 468, and 471 of the Indian Penal Code.
3. As per the prosecution case, sum of Rs. 13,80,000/- was taken by petitioner from informant for ensuring admission of his brother in medical course by impersonating him. He is a doctor at A.I.I.MS., Patna. Subsequently, petitioner sent a forged appointment letter of A.I.I.MS., Deogarh.

Learned Counsel for the petitioner submits that the petitioner is innocent and has not committed any offence as alleged in the F.I.R. and all the amount in question was not paid to the petitioner directly but to different persons. However, without prejudice to the right and contention of the petitioner, the entire
Patna High Court CR. MISC. No.76651 of 2024(2) dt.18-11-2024 2/2 amount of 13 lakhs and odd has been refunded by the petitioner to the informant. Learned counsel for the informant accepts that entire amount has been received by the informant.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the entire money has been returned by the petitioner in favour of the informant, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XIV, Patna, in connection with Phulwarisharif Police Station Case No. 532 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
