The Petitioner seeks regular bail in connection with Special Drugs Case No. 2/2018 arising out of Raniganj P. S. Case No. 159 of 2018, registered for offences punishable under Sections 420, 467, 468, 471 of the Indian Penal Code and 18 (A), 18 (B) and 18 (C)/27 of the Drugs and Cosmetics Act. Allegation as per F.I.R. against the petitioner is that Civil Surgeon, Araria has found that the petitioner is running illegal nursing home without any valid license and registration from the authority concerned.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case and the petitioner was simply an employee of the nursing home on monthly salary
Patna High Court Cr.Misc. No.52201 of 2018 (3) dt.04-10-2018 2/2 and has committed no wrong and now charge sheet has already been submitted against the petitioner and the petitioner is in custody since 08.06.2018.
Heard learned A.P.P also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cumSpecial Judge, Araria in connection with Special ( Drugs) Case No. 2/2018 arising out of Raniganj P.S.Case No.159 of 2018, subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. ii) The petitioner will not induce any witness or tamper with the evidence.
