The petitioner apprehends his arrest in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 238 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that 82.60 liters of illicit country made liquor was recovered from the motorcycle. Learned counsel for the petitioner further submits that the motorcycle does not belong to the petitioner rather the motorcycle belongs to the co-accused Abhishek Kumar. Learned counsel for the petitioner further submits that the petitioner has clean antecedent.

No.65568 of 2019(2) dt.14-11-2019 2/2 In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, subject to deposit of Rs.20,000/- in the court below and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge - II - cum - Special Judge (Excise), Saharsa in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 238 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

Such deposit of Rs.20,000/- shall abide by the outcome of the criminal case.
