The petitioners seek bail in Sasaram (M) P. S. Case No. 778 of 2018 instituted for the offence under Section(s) 37(a), 38(1), 41(1) Bihar Prohibition and Excise Act, 2016. As per seizure list, huge quantity of foreign liquor is alleged to have been recovered by the police. The seizure list is part of the FIR which shows that huge quantity of foreign liquor have been recovered from the truck. On being asked from the persons sitting in the truck, they disclosed their name as Lakhvendra Singh (driver), Chand Singh (driver) and Jaswir Singh (co-driver) who are petitioner nos. 1, 2 and 3 respectively. It is alleged that in total 7,200 litres of illegal
Patna High Court Cr.Misc. No.49922 of 2018(3) dt.01-10-2018 2/2 foreign liquors were recovered from the said truck. On being asked, accused persons did not produce any valid papers. There is total ban of sale and purchase of foreign liquor in the State. But the petitioners were found in possession of such huge quantity of liquor. In such circumstances, this Court is not inclined to grant bail to the petitioners at this stage. The prayer for bail of the petitioners stands rejected. Petitioners may renew prayer for bail after six months if no substantial progress has been made in the trial. (Sanjay Priya, J) shyambihari/- U T
