JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mahua P.S. Case No. 339 of 2016, registered for the offences punishable under Sections 307, 506, 379, 504/34 of the Indian Penal Code and and Section 27 of the Arms Act.

It appears that earlier police has filed final form against the petitioner not finding the case true but later on summons have been issued under Section 319 Cr.P.C. Submission of the learned counsel for the petitioner is that allegation was not found true against petitioner and he is ready to abide by any condition imposed on him and ready to face the trial.

Heard learned A.P.P. also.

Having heard both sides, considering the above facts

Patna High Court CR. MISC. No.67974 of 2019(2) dt.24-10-2019 2/2 as discussed above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned Court below and make prayer for regular bail which shall be considered on the basis of material available on record and considering the fact that petitioner is ready to face trial and ready to abide by any condition imposed on him, the learned court below is directed to dispose of the prayer for bail if possible on the same day.
