JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 This is an application for grant of anticipatory bail in connection with Maker P. S. Case No. 140 of 2019, disclosing offences under Sections 411, 420, 120B, 34 of IPC and Section 27 (b) (ii), 28 of Drugs and Cosmetics Act, 1940 and Section 8(CO, 22 (b) of the N.D.P. S. Act, As per F.I.R. huge quantity of cough syrup has been recovered from a car and driver of the car was succeeded in fleeing away and moreover, accused was arrested from the spot. Submission of the learned counsel for the petitioner is that he is neither the driver nor the owner of the vehicle. He has nothing to do with the cough syrup. There is no other allegation has been mentioned except that he was arrested from the spot. Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.66705 of 2019(2) dt.22-10-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sessions Judge, Saran at Chapra, in connection with Maker P.
