JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) and 38(1) of the Bihar Prohibition and Excise Act,2016.

No doubt, in huge quantity Indian made foreign liquor was recovered from a vehicle but, admittedly, neither petitioner was caught on spot nor anything was recovered from his conscious possession.

The name of petitioner came in this case on the basis of recovery of mobile phone from the place of occurrence and the said mobile phone stands in the name of mother of the petitioner. Petitioner does not have any criminal antecedents and

Patna High Court CR. MISC. No.65423 of 2019(2) dt.04-11-2019 2/2 is languishing in jail custody since 24.7.2019. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Katra P.S.
