JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This is an application for grant of anticipatory bail in connection with Teghra P. S. Case No. 260 of 2019, disclosing offences under Sections 414 and 120B of IPC and Section 30(a) of the Bihar Prohibition and Excise Act, 2018. It has been submitted by learned counsel for the petitioners that petitioner no.2 has been arrested during the pendency of this application. As such, this application against petitioner no.2 stands dismissed as withdrawn. As per F.I.R. on secret information police seized a truck and recovered 141 liters of foreign liquor. However, petitioners and other accused persons succeeded in fleeing away. Submission of the learned counsel for the petitioners

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner no.1, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise-cum-A.D.J.-II, Begusarai, in connection with Teghra P. S. Case No. 260 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
