JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 354, 376, 511, 307, 379 of the Indian Penal Code.
As per the prosecution case, the petitioner tried to outrage the modesty of the complainant.
Learned counsel for the petitioner submitted that the alleged occurrence is of date 11.07.2022 while the complaint case was lodged on 15.07.2022 and there is no cogent reason behind the delay in lodging the complaint case. In fact, the scuffle took place between the parties when goats of the
Patna High Court CR. MISC. No.72419 of 2022(2) dt.05-05-2023 2/2 complainant grazed the Arhar crops of the petitioner. Taking advantage of the situation, this false and concocted case has been lodged. The petitioner has got clean antecedent. Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-IV, Kaimur at Bhabua in connection with Complaint Case No. 946 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
