JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-10-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The Petitioners seek regular bail in connection with G.R. No. 1925 of 2013 arising out of Bangaon P. S. Case No. 64 of 2013, registered for offences punishable under Sections 147, 341, 323, 379 and 504 of the Indian Penal Code and Sections 3/4 of Dian Act.

Allegation against the petitioners and other accused persons is of assaulting the informant and calling her "Dian" and these petitioners have tried to administer night soil to her. Submission of the learned counsel for the petitioners is that the petitioners have falsely been implicated in the present case and from perusal of F.I.R., it is evident that the other accused persons also assaulted with legs and fists of the

Patna High Court Cr.Misc. No.52193 of 2018 (3) dt.04-10-2018 2/2 informant. It is also submitted that both parties are neighbors and petitioners are in jail custody since 06.06.2018 and 13.06. 2018 and charge sheet have already been submitted against the petitioners.

Heard learned A.P.P also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- IV, Saharsa in connection with Bangaon P.S.Case No. 64 of 2013, subject to the following conditions:- i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

ii) The petitioners will not induce any witness or tamper with the evidence.
