Petitioner seeks bail in Sonpur-Hajipur Rail P.S. Case No.30 of 2018 instituted for the offence under Section(s) 414 Indian Penal Code and Sections 20, 22 and 08 of the NDPS Act pending in the court of the Sessions Judge, Hajipur. It is alleged that total 17 Kg. Ganja has been recovered from possession of the petitioner while traveling in train. Seizure list is part of the First Information Report from which it appears that Ganja has been recovered from various bags as mentioned, in detail, in seizure list.
It appears from para 3 of the bail petition that the petitioner has criminal antecedents. He is accused in different
Patna High Court Cr.Misc. No.51202 of 2018 (3) dt.26-10-2018 2/2 cases for the offence under Section(s) 395, 397, 411, 414 Indian Penal Code.
In such circumstances, this Court is not inclined to enlarge the petitioner on bail.
Prayer of the petitioner for grant of bail is rejected. The Court below is directed to expedite the trial. Liberty is given to the petitioner to renew his prayer for bail after six months if no substantial progress is made in trial. (Sanjay Priya, J) JA/- Rohit Kr.
