While, learned counsel for the petitioner relied upon Annexure 2 which is a copy of the F.I.R being Khagaria (C. Nagar) P.S.Case No.398 of 2016 lodged at the instance of the learned Presiding Officer, Family Court, Khagaria, against the Opposite Party for the alleged assault committed by him against this petitioner on the date fixed in the matter, learned counsel for the Opposite Party submits that both the parties have lodged the case against each other. There are allegations and counter allegations but in the given circumstance he would have no objection if the records of the case is transferred from the Court at Khagaria to the Court at Bhagalpur.

Patna High Court MJC No.1708 of 2017 (6) dt.04-09-2018 2/2 Since, learned counsel for the Opposite Party has while denying the allegations is not contesting the transfer of the case, let the records of Matrimonial Case No. 36 of 2017 pending in the Court of learned Principal Judge, Khagaria, be transferred to the Court of learned Principal Judge, Family Court, Bhagalpur within a period 15 days from the date of receipt/production of a copy of this order.

The writ application stands disposed off.
