Petitioner, who is in custody, seeks bail in connection with Itarhi P.S. Case No. 62 of 2018 registered for the offences punishable under Sections 341, 323, 307, 379, 34 and 302 of the Indian Penal Code.
Informant who is the son of the deceased has alleged that petitioner along with other co-accused came to his shop and looted articles and on objection one co-accused Bachan Rajbhar fired upon his father which hits on his waist and fell down.
It has been submitted on behalf of the petitioner that he is innocent. He has been falsely implicated in this case. He was only a member of mob and no overt act alleged against
Patna High Court Cr.Misc. No.51639 of 2018(3) dt.26-11-2018 2/2 him. The alleged occurrence took place on 11.03.2018 and FIR instituted on 13.03.2018. He has no criminal antecedent. He is in custody since 25.06.2018. It has been further submitted that similarly placed co-accused has been granted bail by another coordinate Bench of this order in Cr. Misc. No. 64175 of 2018 vide order dated 25.10.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- II, Buxar in connection with Itarhi P.S. Case No. 62 of 2018.
