JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-03-2023 At the outset, the learned counsel for the petitioner has submitted that though the petitioner has filed an application way back in the year 2013 for transfer of arms license and release of the arms in question, pursuant to the death of his father on 05.09.2009, however, in view of coming into force of the New Arms Rules, 2016, the petitioner be granted liberty to file a fresh application for transfer of arms licence, existing in the name of the deceased father of the petitioner, as also for release of the arms in question and a time frame be fixed for disposal of the same.

Patna High Court CWJC No.18174 of 2022(2) dt.15-03-2023 2/2 Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with liberty to the petitioner to file an appropriate application for transfer of the arms license in question as also for release of the arms in question, and in case such application is filed, in accordance with the provisions contained in the Arms Rules, 2016, within a period of four weeks from today, the same shall be considered by the District Arms Magistrate concerned, in accordance with law, and appropriate orders shall be passed within a period of six weeks, thereafter.
