JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-12-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Town P.S. Case No. 12 of 2018 for the offence under Sections 363, 366A, 328, 376 of the Indian Penal Code. After some argument, learned counsel for the petitioner seeks permission to withdraw the present application in order to approach the court below for grant of regular bail. Permission is accorded.

In the event, the petitioner surrenders before the court below and prays for regular bail, the court below is directed to dispose of the application for grant of bail on the same day on its own merit without being influenced by the dismissal of anticipatory bail application by this Court.
