Petitioner seeks bail in Sessions Trial No. 372 of 2018 arising out of Nayagaon P.S. Case No. 34 of 2002 registered for the offence punishable under Sections 364/34 of the Indian Penal Code.
Allegation against the petitioner is of kidnapping the son of the informant from Sisbani (Machan).
It has been submitted on behalf of the petitioner that FIR is against unknown. The name of the petitioner has surfaced in this case on the basis of information given by Spy to the I.O. Similarly, situated co-accused persons have been granted bail by co-ordinate benches of this Court vide orders dated 03.05.2017 in
Patna High Court Cr.Misc. No.52812 of 2018(3) dt.13-09-2018 2/2 Criminal Miscellaneous No. 5467 of 2017 and dated 12.04.2018 in Criminal Miscellaneous No. 11019 of 2018. Petitioner is in custody since 15.06.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 1st Begusarai, in connection with Sessions Trial No. 372 of 2018 arising out of Nayagaon P.S. Case No. 34 of 2002.
