The petitioner has prayed for bail in connection with Muffasil P.S. Case No. 272 of 2019 registered for the offence punishable under Sections 399, 402 of the Indian Penal Code and Sections 25 (1-b)a, 26, 35 of the Arms Act. As per allegation in the FIR, petitioner along with other six accused persons were hatching a conspiracy to commit a crime and on seeing the police party five accused were succeeded in fleeing away but on chase two persons including the petitioner were apprehended. On search, one knife was recovered from possession of the petitioner.
It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.65288 of 2019(2) dt.04-11-2019 2/2 that petitioner has been falsely implicated in this case. There is no overt act against the petitioner. He has no criminal antecedent. Petitioner is in custody since 20.06.2019. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Muffasil P.S. Case No. 272 of 2019.
