The petitioners, who are in custody, seek bail in connection with Nath Nagar (Lalmatiya) P.S. Case No. 446 of 2018 registered for the offence punishable under Sections 30(A), 38(2) of Excise Act and 420/34 of Indian Penal Code. Allegation in FIR is that during course of checking of vehicle, all of sudden one Tata Indica Vehicle stopped and two persons tried to flee away and on suspicion police personnel reached there and in course of search 299.2 litres country made liquor was recovered from the vehicle.
It has been submitted on behalf of the petitioners
Patna High Court Cr.Misc. No.52068 of 2018(3) dt.18-09-2018 2/2 that petitioners that they are driver and co-driver of vehicle and were not aware of country made liquor kept in the vehicle. They are in custody since 16.07.2018. They have no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned IInd Additional District & Sessions Judge-cum-Special Judge, Excise Act, Bhagalpur, in connection with Nath Nagar (Lalmatiya) P.S. Case No. 446 of 2018.
