JUSTICE ARVIND SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner seeks bail in connection with Bath. P.S. Case No. 16 of 2019 registered for the offence punishable under Sections 302 and 201 of the Indian Penal Code and Section 27 of the Arms Act.
As per allegation in the FIR, dead body of the husband of the informant was found on the road at village Kastikri with gunshot injury in his temporal region. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner is not named in the FIR. On the basis of confessional statement before the police made by co-accused Rajeev Kumar Choudhary, the name of petitioner has came in this case. Co-
Patna High Court CR. MISC. No.65270 of 2019(2) dt.04-11-2019 2/2 accused Murlidhar Jha has already been granted bail by a coordinate Bench of this Court vide order dated 16.10.2019 passed in Cri. Misc. No. 44675 of 2019 and the case of the petitioner stands on better footing to that of the co-accused. Petitioner has got no criminal antecedent. He is in custody since 04.05.2019. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., XIII, Bhagalpur in connection with Bath P.S. Case No. 16 of 2019.
