2. The petitioner seeks bail in connection with Excise P.S. Case No. 301 of 2022 instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act.

3. Earlier, vide order dated 15.02.2025 passed in Cr. Misc. No. 5245 of 2025, the petitioner was granted anticipatory bail by a coordinate Bench of this Court.

4. Prosecution case, in short, is that total 100 litres of wiscof cough syrup has been recovered in this case.

5. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that earlier vide order dated 15.02.2025 passed in Cr. Misc. No. 5245 of 2025, the petitioner was granted anticipatory bail by a coordinate Bench of this Court, however, the bail bond of the petitioner were not accepted in light of the condition imposed by the coordinate Bench while granting bail, and consequently, the petitioner surrendered before the learned court below on 04.09.2025 and since then, he is in custody. There is no allegation of tampering of witnesses alleged against the petitioner. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel further submitted that petitioner is neither the owner nor the driver of the vehicle in question. There is no compliance of Section 100 of Cr.P.C./103 of BNSS.

6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

7. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

8. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two
