JUSTICE SANJAY PRIYA ORAL ORDER 3/ 25-10-2018 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Sheosagar P.S. Case No.97 of 2017 instituted for the offence under Section(s) 341, 342, 323, 307, 379/34 Indian Penal Code.

Counsel for the petitioner submits that petitioner has clean antecedents.

It is alleged in the written report that petitioner caused fire arm injury to the informant.

Counsel for the informant has appeared and submitted that this petitioner has caused fire arm injury in the chest of the informant.

Injury report of the informant is annexed as

Patna High Court Cr.Misc. No.51428 of 2018 (3) dt.25-10-2018 2/2 Annexure-2, wherein, doctor after x-ray has not found any sign of bony lesion. The doctor has opined the injury to be simple in nature.

Petitioner is in custody since 04.06.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Judge VII-cum-Additional Chief Judicial Magistrate, Sasaram, Rohtas, in connection with Sheosagar P.S. Case No.97 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
