JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-11-2019 The petitioners apprehend their arrest in connection with Laukahi P. S. Case No. 58 of 2015 registered under Sections 147,149,307,323,324,341 and 504 of the Indian Penal Code. Allegation against the petitioners is that petitioners along with other accused persons assaulted the informant and others. Learned counsel appearing on behalf of the petitioners submits that both parties are agnates and there is land dispute between them. He further submits that in fact the allegation of assault is upon Basudeo Yadav who has been granted regular bail by a co-ordinate Bench of this Court in Cr. Misc. No. 39854 of 2015. He further submits that no specific allegation of assault is there upon the petitioners and petitioners are ready to abide by the terms and conditions of bail being imposed by this Court.

No.65266 of 2019(2) dt.04-11-2019 2/2 Having regard to the submissions made by the parties and taking into consideration the fact that no specific allegation of assault is there against the petitioners and both parties are agnates, as such I am inclined to grant anticipatory bail to the petitioners.

Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned ACJM-III, Jhanjharpur, Madhubani in connection with Laukahi P.S.Case No. 58 of 2015; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further conditions that petitioners shall remain physically present before the police/Court, as the case may be, as and when required, and in case of failure on their part to appear before the Court on two consecutive dates without any reasonable cause, their bail bond shall be liable to be cancelled.
