2. Petitioner seeks bail who is in custody since 21.05.2022 in connection with Sessions Case No. 1333 of 2022 arising out of Patrakar Nagar P.S. Case No. 258 of 2022, F.I.R. dated 17.05.2022 for the offences punishable under Sections 376, 302/34 of the Indian Penal Code.

3. Earlier the bail application of the petitioner was rejected by this Hon'ble Court vide order dated 16.02.2023 passed in Cr. Misc. No. 48001 of 2022.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and she has falsely been implicated in the present case. He further submits that the petitioner is not named in the F.I.R. and the name of the

Patna High Court CR. MISC. No.74384 of 2023(5) dt.19-04-2024 2/2 petitioner has been transpired during investigation on the basis of the confessional statement of the co-accused who happens to be the husband of the petitioner and the same is recorded in paragraph no. 26 of the case diary.

5. Vide order dated 02.02.2024 a report was called with regard to the present stage of trial. Report of the learned Trial Court dated 04.03.2024 reveals that 4 witnesses have already been examined out of 5 charge sheet witnesses.

6. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner.

7. Considering the aforesaid facts and circumstances as well as report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with Sessions Case No. 1333 of 2022 arising out of Patrakar Nagar P.S. Case No. 258 of 2022 pending in the court of learned Additional District & Sessions Judge 1st, Patna.

8. Prayer is refused.

9. However, learned Trial Court is directed to expedite and conclude the trial at the earliest.
