2. The petitioner is in custody in connection with Mahila P.S. Case No. 20 of 2024 for the offence punishable under sections 376 of the Indian Penal Code and Sections 4 and 6 of the POCSO Act lodged on 13.06.2024 by the informant, Nitu Devi.
3. As per the prosecution story, the informant alleged that his daughter (x), 12 years of age, went to the Government Building near the Hospital where it is alleged that this petitioner who is serving as Tola Sevak took her in a room and raped her. When the girl protested, she was also beaten by this petitioner. Accordingly, the FIR.

Though learned counsel for the petitioner tried to impress upon this Court about the innocence of the accused submitting that the medical report does not support it, learned APP has taken this Court to the learned Sessions Judge's order to show that the victim girl under Section 164 of the Cr.P.C. has fully supported the prosecution story.
5. Considering the allegation that has come against the petitioner of having raped a twelve years old child despite the fact that he is a Tola Sevak, this Court does not deem it fit and proper to extend him the privilege of bail.
