Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 23.1.2019 passed in Cr. Misc. No.1539 of 2019 with condition to surrender within a period of six weeks. It appears that he has not surrendered and now filed a modification application for extension of time to surrender.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, if the petitioner surrenders and pray for regular bail, the same shall be considered on its own

Patna High Court CR. MISC. No.67609 of 2019(2) dt.06-11-2019 2/2 merit and also on submission that he has deposited the defalcated amount and considering the same, he will pass appropriate order, if possible on the same day . With the aforesaid direction, this application is disposed of.
