The petitioner seeks pre-arrest bail in connection with Bhabhua P.S. Case No. 338 of 2019 registered under Sections 302, 201 and 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that except wild suspicion and hypothetical presumption there is no material to connect the petitioner with the offence alleged.

On the other hand, learned counsel appearing for the State being assisted by the learned counsel for the informant submitted that the informant has suspected that because of land dispute existing between two brothers, the petitioner might be

Regard being had to the fact that apart from suspicion, there is no other material to connect the petitioner with the offence alleged and the petitioner has got no criminal antecedent, in the event of arrest or surrender before the court below, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabhua in connection with Bhabhua P.S.
