The petitioner seeks regular bail in connection with Bangaon P.S. Case No. 79 of 2019, registered for the offence punishable under Sections 304(B), 201, 120(B), 34 of the Indian Penal Code.
The allegation is regarding the accused persons including the petitioner herein, who is the husband of the deceased victim lady, having killed the deceased victim lady on account of nonfulfillment of the demand for dowry. The learned counsel for the petitioner has submitted that the petitioner is innocent and he has been falsely implicated in the present case, just because he happens to be the husband of the deceased victim lady. I have heard the learned counsel for the petitioner and perused the materials on record, as also the case diary from which it is clear that the petitioner is the husband of the deceased victim lady and while he was trying to burn her dead body after killing her, police had arrived and the petitioner was apprehended from the spot, as also the dead body of the deceased victim lady was recovered from the orchard where the petitioner was trying to burn the dead body. The police, upon investigation, has found the occurrence to be true and has submitted charge-sheet under Section 302 of the Indian Penal Code against the petitioner herein.
Considering the heinous nature of crime committed by the petitioner and the allegations having been prima facie found to be true, as also there being ample materials in the case diary to corroborate the complicity of the petitioner in the alleged crime, I am not inclined to grant regular bail to the petitioner herein, hence, the present petition stands dismissed.
